2. Project Requirements

Clients are responsible for providing accurate project information, content, images, branding materials, website access, hosting information, and other materials reasonably required to complete the project.

Delays in providing required information, approvals, credentials, or feedback may result in changes to the project timeline.

3. Payments

All project fees and payment terms will be agreed upon before work begins.

Depending on the project, we may require an upfront payment or milestone payments before beginning or continuing development work.

Work may be paused or withheld if agreed payments are not received on time.

Unless otherwise agreed in writing, payments for completed work are non-refundable once the relevant work or milestone has been delivered.

4. Project Timeline

We will make reasonable efforts to complete projects within the agreed timeframe.

However, timelines may change due to:

• Delays in receiving content or information
• Delayed client feedback or approvals
• Changes to project requirements
• Third-party service or hosting issues
• Technical issues outside our reasonable control
• Additional work requested after the original scope was approved

We will communicate significant changes to the expected timeline where reasonably possible.

5. Revisions and Changes

The number of revisions included in a project will depend on the agreed project scope or package.

Requests that substantially change the original design, functionality, structure, or scope may be considered additional work and may incur additional charges.

Additional work will generally be discussed and approved before it is completed.

6. Client Responsibilities

The client is responsible for:

• Providing accurate information and content
• Providing required website and hosting access
• Reviewing submitted work
• Providing timely feedback
• Ensuring they have permission to use supplied images, text, logos, videos, and other materials
• Maintaining ownership and access to their domain and hosting accounts

AK Web Design Services is not responsible for delays caused by missing or inaccurate client-provided information.

7. Website Content and Third-Party Materials

Unless specifically agreed otherwise, the client is responsible for providing or obtaining licenses for copyrighted content, images, fonts, videos, logos, trademarks, and other materials used on their website.

The client is responsible for ensuring that all materials supplied to us may legally be used.

8. Third-Party Services and Plugins

WordPress websites may rely on third-party themes, plugins, hosting providers, payment gateways, APIs, fonts, software, or other services.

We do not guarantee the continued availability, compatibility, pricing, security, or functionality of third-party products or services.

Third-party subscription fees, licenses, hosting fees, premium plugins, domains, and other external costs are generally the client's responsibility unless specifically included in the agreed project price.

9. Website Performance and SEO

We aim to create websites that are responsive, user-friendly, optimized for performance, and built using SEO-friendly development practices.

However, website development does not guarantee specific search engine rankings, traffic levels, sales, leads, conversions, or revenue.

Search engine performance depends on many factors outside our control.

10. Website Security and Maintenance

We take reasonable measures when developing websites, but no website can be guaranteed to be completely secure.

After project completion, ongoing updates, backups, security monitoring, hosting configuration, and maintenance may be the client's responsibility unless a separate maintenance service has been agreed upon.

11. Intellectual Property

Unless otherwise agreed, the client will receive the rights to the final website work for which full payment has been received.

Third-party themes, plugins, fonts, images, software, and other licensed materials remain subject to their respective licenses.

AK Web Design Services may retain ownership of reusable development techniques, code libraries, frameworks, processes, and general know-how used to create projects.

12. Portfolio Rights

Unless the client specifically requests otherwise in writing, AK Web Design Services may display completed website projects in its portfolio, website, social media, or promotional materials for the purpose of demonstrating previous work.

If a project is confidential or cannot be publicly displayed, the client should inform us before project completion.

13. Website Launch and Handover

Once the agreed project has been completed and approved, the website may be launched or handed over to the client.

The client is responsible for ensuring that all final content, links, forms, products, prices, and other business information are accurate before launch.

14. Cancellation or Termination

Either party may request to cancel a project subject to the agreed payment and project terms.

If a client cancels a project after work has started, fees may be charged for work already completed, time spent, purchased resources, and other approved project expenses.

15. Limitation of Liability

To the maximum extent permitted by applicable law, AK Web Design Services will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or services.

We are not responsible for losses caused by third-party hosting providers, plugins, software, payment processors, domain providers, security incidents, cyberattacks, or other circumstances outside our reasonable control.

16. No Guarantee of Business Results

Our services are intended to provide professional website design and development. However, we do not guarantee specific business outcomes, including sales, leads, rankings, traffic, customer growth, or revenue.

17. Force Majeure

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet or hosting outages, technical failures, cyberattacks, government actions, third-party service interruptions, or other unforeseen events.
